INSTRUCTIONS

RELATIVE TO CIRCULATION

       OF PETITION

1.         The person who circulates a petition for the purpose of obtaining signatures must be an owner of taxable real estate located in the County.

2.         The person who circulates each petition and signs the verifying affidavit at the end of that petition must sign the petition.  The best practice is for that person to sign that petition on the first line.  IT IS ESSENTIAL THAT THE VERIFYING AFFIDAVIT BE COMPLETED AND SIGNED BEFORE A NOTARY AND THAT THE NOTARY BLOCK ALSO BE COMPLETED.

3.         Petitions cannot be passed around from one person to another for circulation.

4.         The signatures on each petition must be made in the presence of the person who circulates the petition and signs the verifying affidavit.

5.         Qualified petitioners are owners of taxable real estate located in the County, as shown by the real property tax records in the Auditor’s office.  Persons purchasing real estate on contract, heirs in estates in which the real estate has not been distributed, and other persons whose ownership is not of record in the Auditor’s office are not qualified petitioners.

6.         One person cannot sign for another.  A husband and wife owning real estate jointly are each qualified petitioners, and it is not necessary for each to sign in order for the other to constitute a valid petitioner; however, each must sign separately if the signatures are to be counted as signatures for two separate petitioners.  In such cases the wife should not sign as “Mrs. Joe Jones,” but should sign her own name, thus “Mary Jones.”

7.         All names should be written and printed as they appear on the tax records in the County Auditor’s office, as nearly as possible.

TO:     THE BOARD OF COMMISSIONERS OF THE COUNTY OF GREENE, INDIANA

The undersigned, owners of real property in the County of Greene, Indiana, are in favor of and hereby petition FOR the following:

The Board of Commissioners and the County shall enter into negotiations with the Greene County Building Corporation, a non-profit corporation (the “Building Corporation”) to perform additional work for the acquisition, renovation, construction and equipping of the original project for which bonds were previously issued (the “Original Project”) for the existing County Courthouse (the “Existing Courthouse”), including the site and appurtenances thereto (the “Additional Project”), and including litigation costs and costs due to delay of the Original Project, and shall enter into a modified lease between the Building Corporation, as lessor, and Greene County, Indiana, as lessee, for the Existing Courthouse (the “Modified Lease”).  The total cost for the Additional Project shall not exceed _____________________, all or a portion of which shall be paid for through the Modified Lease payments to the Building Corporation which will issue additional bonds to complete the Additional Project.  The Existing Courthouse is located at the common street address of County Courthouse, Bloomfield, Indiana in the County.  We believe that a need exists for the acquisition, renovation and equipping of the Additional Project, and that the County cannot provide the necessary funds to pay the costs of acquisition, renovation and equipping of the Additional Project without entering into such Modified Lease.  We urge that pursuant to Indiana Code Title 36, Article 1, Chapter 10, such action to lease the Additional Project be taken as promptly as possible under Indiana law to secure the acquisition, renovation and equipping of the needed Additional Project. 

This petition may be circulated in several counterparts, and all such counterparts are to be considered as constituting one (1) petition.

_________________________________________, being first duly sworn upon his/her oath deposes and says that he/she is one of the signers (on line ___) of the attached Petition addressed to the Board of Commissioners of the County of Greene, Indiana (the “County”), in favor of and petitioning the County to enter into negotiations with the Greene County Building Corporation, a non-profit corporation the “Building Corporation”) to perform additional work for the acquisition, renovation, construction and equipping of the original project for which bonds were previously issued (the “Original Project”) for the existing County Courthouse (the “Existing Courthouse”), including the site and appurtenances thereto (the “Additional Project”), including litigation costs and costs due to delay of the Original Project, and shall enter into a modified lease between the Building Corporation, as lessor, and Greene County, Indiana, as lessee, for the Existing Courthouse (the “Modified Lease”); and that all signatures appearing on the attached Petition were affixed in his/her presence on the date indicated for each signature, and are the true and lawful signatures of the persons signing the Petition.
